A Local Law to amend the administrative code of the city of New York, in relation to sidewalk shed inspections. This bill would require that sidewalk sheds that have been installed for more than one year to undergo safety inspections at least once every six months by the Department of Buildings at the cost of the building owner for which the shed has been installed.
Be it enacted by the Council as follows:
Section 1. Section BC 3307.6.5.8 of the New York city building code, as amended by local law 141 for the year 2013, is amended to read as follows::
3307.6.5.8. Periodic inspection. Six months following the initial installation inspection, and every six months thereafter, the sidewalk shed shall be inspected by [a qualified person designated by the designer, the permit holder for the shed, or a third party acceptable to both the designer and the permit holder] the department to verify that the sidewalk shed is in a safe condition and is in compliance with drawings and the requirements of this chapter. [Following the inspection, the qualified person who inspected the sidewalk shed shall prepare, sign, and date an inspection report.] The department shall charge the owner of a building, to which such sidewalk shed is attached, a fee for each inspection performed by the department, provided that such fees shall at least be determined based on the size of the sidewalk shed that is being inspected, be no less than $250 for the first inspection and be increased for each subsequent inspection.
§ 2. This local law takes effect 90 days after it becomes law.
